DockOne – Terms of Use
Trial Version 1.0 | Effective 29/10/2026
1. About these terms
1.1 DockOne is marina management software owned and operated by DockOne Limited (company number 9469275) (DockOne Limited, we, us).
1.2 By ticking “I agree” and using DockOne you accept these terms for yourself and, if you use DockOne for a marina or other organisation, on behalf of that organisation. If you do not agree, please do not use DockOne.
1.3 If your organisation has signed a Trial Agreement with DockOne Limited, that agreement prevails over these terms wherever the two differ.
2. Trial licence
2.1 DockOne is currently offered as a trial. We grant you a limited, non-exclusive, non-transferable, revocable licence to use DockOne during the trial period to evaluate it for your own marina operations.
2.2 We may change, suspend or end the trial at any time. All rights not expressly granted to you are reserved.
3. Ownership
3.1 DockOne, including its software code, database design, screens, layouts, workflows, documentation, name and logo, is protected by copyright and other intellectual property rights owned by us or our licensors. Nothing in these terms transfers any ownership to you.
3.2 © 2026 DockOne Limited. All rights reserved.
4. What you must not do
You must not, and must not help or allow anyone else to:
(a) copy, modify, translate, sell, rent, sublicense or distribute DockOne or any part of it;
(b) reverse engineer, decompile, disassemble or try to obtain the source code of DockOne;
(c) use DockOne, or anything you learn from it, to build or help build a competing product or service;
(d) remove or alter any copyright, ownership or confidentiality notices;
(e) share your login with anyone outside your organisation, or let anyone outside it view DockOne;
(f) take screenshots, recordings or other copies of DockOne’s screens or workflows and share them with third parties without our written consent;
(g) use bots, scrapers or other automated tools to extract content or data, or probe, scan or test DockOne’s security; or
(h) use DockOne unlawfully or in a way that could damage, overload or interfere with it or other users.
5. Confidentiality
5.1 The non-public features, designs, workflows, plans and workings of DockOne are our confidential information. You must keep them confidential, use them only to evaluate DockOne, and not disclose them to anyone outside your organisation without our written consent. This obligation continues after the trial ends.
6. Feedback
6.1 We welcome feedback. If you give us suggestions, ideas or comments about DockOne, we may use them freely without payment or obligation to you, and they do not give you any rights in DockOne.
7. Your data and privacy
7.1 Your organisation owns the data it enters into DockOne. We use it only to provide, support, secure and improve DockOne, as described in our Privacy Policy.
7.2 You must make sure you are entitled to enter any personal information into DockOne, and that the people it relates to have been told about it as the Privacy Act 2020 requires.
8. Accounts and security
8.1 You are responsible for activity under your login. Keep your password secure and tell us promptly if you think someone else has accessed your account.
9. No guarantees and limits on liability
9.1 DockOne is a trial product provided “as is”. It may contain errors, change without notice or be unavailable at times. Please keep your own backups of anything critical and do not rely on DockOne as your only record during the trial.
9.2 To the extent the law allows, we exclude all implied warranties and are not liable for indirect or consequential loss, loss of profit or loss of data. Our total liability to you in connection with the trial is limited to NZ$1.00.
9.3 If you use DockOne in trade, you and we agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, to the extent the law permits this. Nothing in these terms limits any right or liability that cannot lawfully be excluded.
10. Ending your use
10.1 You may stop using DockOne at any time. We may suspend or end your access at any time, including if you breach these terms. Sections 3 to 7 and 9 continue after your access ends.
11. Changes and general
11.1 We may update these terms and will tell you in DockOne before changes take effect. Continued use after that means you accept the updated terms.
11.2 These terms are governed by New Zealand law and the New Zealand courts have jurisdiction.
